Murphy, Hesse, Toomey & Lehane, LLP Partner Presents at the Michigan Union Construction Industry Conference

 

On October 7, 2022, Attorney Kier Wachterhauser, a Partner at Murphy, Hesse, Toomey & Lehane, LLP, spoke at the Michigan Union Construction Industry Conference outside of Detroit Michigan.  The conference was organized by the International Foundation of Employee Benefit Plans and Attorney Wachterhauser presented on a variety of highly relevant topics for employers.  Topics included updates on paid leave, the state of the pandemic and its effect on employers, issues of harassment and other forms of workplace discrimination, and activity at the National Labor Relations Board.

 

Mr. Wachterhauser is a Partner at MHTL and represents private and public sector clients in all areas of labor and employment law while maintaining a general litigation practice within the firm.  He regularly counsels clients on employment matters, including wage and hour, leave entitlements, and discrimination and harassment matters, as well as the drafting of employment policies and contracts, and represents clients in employment-related litigation before state and federal courts and administrative bodies. Additionally, he maintains an extensive labor practice, representing clients in the collective bargaining process, arbitration hearings, and proceedings in front of a variety of administrative agencies. He is a regular speaker at industry and trade groups, chambers of commerce, and other organizations on a wide range of labor and employment topics, and he conducts workplace training for organizations of all sizes. Mr. Wachterhauser received his Juris Doctor from Boston University School of Law, where he served as the Editor-in-Chief of the Boston University Law Review.

Statutory Regulations Released for Interagency Review of Complex Cases

On March 1, 2024, EOHHS and DESE released the long-awaited, final adoption of the regulations governing the Interagency Review of Complex Cases (published as 101 CMR 27.00). These regulations had been anticipated since the Massachusetts Legislature passed “An Act Addressing Barriers to Care for Mental Health” in August, 2022. The purpose of the law is the establishment of a team that will collaborate on complex cases where there is an urgent need to address a lack of consensus between state agencies about the service needs or placement of an individual. This replaces what was known as the Unified Planning Team, or “UPT”. The co-chairs of the IRT will be the secretary (or a designee) from EOHHS and the commissioner (or a designee) of DESE.
